Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of Realty Cruiser (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent ("Customer").
2. Controller and Processor Roles
- Customer as Controller: The Customer is responsible for the legality, accuracy, source, notice, consent status, and permitted use of all leads, contacts, phone numbers, property data, and other Customer Data collected, scraped, uploaded, synced, or transmitted through the Service.
- Realty Cruiser as Processor: For Customer Data processed through the Service, Realty Cruiser acts as a data processor or service provider operating on Customer instructions.
- Authorized Users: The Customer is responsible for all acts and omissions of its users, contractors, agents, and anyone using the Service through the Customer's accounts.
3. Web Scraping, Data Origin, and Source Compliance
The Service may include tools that help Customers organize or import information collected from public websites, listing portals, public records, directories, and other third-party sources. The Customer, not Realty Cruiser, selects the target sources and controls the means and purpose of that collection.
- Lawful source obligation: You represent and warrant that all data you scrape, collect, upload, or process through the Service was collected lawfully and may be used for your intended business purpose under applicable contract, privacy, consumer protection, intellectual property, computer access, and competition laws.
- Robots.txt and public access standards: You agree to follow applicable robots.txt directives, public-data access standards, site rate limits, and any source-site terms that govern automated access or reuse.
- No circumvention: You may not use the Service to bypass authentication requirements, paywalls, anti-bot controls, CAPTCHAs, access restrictions, or technical measures intended to block unauthorized collection.
- Scraping risk allocation: You acknowledge that Realty Cruiser does not independently verify whether a specific scrape, crawl, copy, extraction, or reuse is lawful in a given jurisdiction.
4. Messaging Consent, TCPA, and Carrier Compliance
The Service can enable outbound and inbound communications, including SMS, MMS, WhatsApp, and VoIP workflows. You are solely responsible for compliance with all applicable messaging and telecom laws, including the TCPA, TSR, CAN-SPAM, Do-Not-Call rules, CTIA guidance, carrier policies, state mini-TCPA statutes, and non-U.S. equivalents.
- Prior Express Written Consent: You represent and warrant that, before sending any marketing, automated, or regulated message through the Service, you have obtained and documented Prior Express Written Consent or other legally sufficient consent for each recipient as required by applicable law.
- Proof of consent: You must maintain auditable evidence of consent, including date, time, source, method, scope, and revocation status, and provide that evidence upon reasonable request.
- Mandatory opt-out honoring: You may not send messages to recipients who have opted out. The Service may automatically append opt-out language, record STOP-equivalent keywords, and globally suppress recipients after opt-out requests.
- No bypassing suppression: You are prohibited from bypassing, reversing, or evading any STOP, unsubscribe, blacklist, or do-not-contact control unless you have obtained new lawful consent and reactivation is permitted by applicable law.
- Prohibited campaigns: You may not use the Service for unlawful robocalling, spoofing, harassment, phishing, deceptive outreach, or high-volume spam.
5. AI Features and Fair Housing Guard
The Service may include AI-assisted features such as summaries, message suggestions, follow-up plans, and the AI Profit Forecaster.
- Probabilistic output: AI output is probabilistic and may be inaccurate, incomplete, or inappropriate. Human review is required before use.
- Physical property and market inputs: The AI Profit Forecaster is intended to evaluate property characteristics and market indicators such as pricing, days on market, square footage, distress signals, and currency factors.
- No protected-class processing for scoring: Realty Cruiser does not intend the AI Profit Forecaster to use, store, or process protected-class data such as race, color, religion, sex, disability, familial status, national origin, ethnicity, citizenship, or similar sensitive traits in scoring logic.
- No discriminatory use: You may not use the Service, AI outputs, or lead segmentation features to make or support unlawful discriminatory housing, lending, insurance, employment, or marketing decisions.
- No professional advice: AI outputs are informational only and are not legal, financial, tax, brokerage, MLS, or compliance advice.
6. Acceptable Use
You agree not to misuse the Service. Prohibited conduct includes:
- Attempting to gain unauthorized access to accounts, systems, or data.
- Uploading malware, interfering with service availability, or scraping at abusive rates.
- Using the Service to violate privacy, consumer protection, anti-spam, housing, intellectual property, or computer misuse laws.
- Submitting protected-class or sensitive data for unlawful profiling or discriminatory decision-making.
- Using the Service to generate deceptive, misleading, fraudulent, or non-compliant communications.
7. Third-Party Services and Dependency Disclaimer
The Service may integrate with third-party systems such as communications providers, AI model providers, hosting vendors, proxies, analytics vendors, and other dependencies. Your use of those services may be subject to separate third-party terms.
Service continuity disclaimer: We do not guarantee uninterrupted availability of any scraping source, portal, API, model, communications route, or integration, and we are not liable for outages, rate limits, anti-bot countermeasures, source changes, carrier filtering, or third-party suspensions.
Best-effort degradation: When external dependencies fail, the Service may degrade gracefully, queue, block, or reject actions to preserve system stability, legal compliance, or provider standing.
8. Fees, Billing, and Taxes
If you purchase a paid subscription, you agree to pay all fees and applicable taxes. Unless otherwise required by law or expressly stated in a signed order form, fees are non-refundable.
9. Customer Data, Portability, and Deletion
We will handle Customer Data in accordance with our Privacy Policy. You represent that you have all rights necessary to provide Customer Data to the Service for processing.
- Portability: Authorized administrators may export available CRM data in the formats made available by the Service.
- Deletion and erasure: We may offer deletion, anonymization, or deep-scrub workflows for Customer Data, subject to legal retention, suppression, fraud-prevention, audit, and evidentiary requirements.
10. Suspension and Termination
We may suspend, throttle, block, or terminate access if we reasonably believe your use violates these Terms, provider rules, applicable law, or poses legal, operational, security, or reputational risk. You may stop using the Service at any time.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, LEAD QUALITY, DATA ACCURACY, CAMPAIGN PERFORMANCE, SCRAPING UPTIME, SOURCE AVAILABILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, CONTRACTS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
- LIABILITY CAP: OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY CUSTOMER TO US FOR THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to defend, indemnify, and hold harmless Realty Cruiser, its affiliates, and their respective officers, employees, and agents from and against any claims, actions, investigations, damages, losses, liabilities, judgments, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- your Customer Data or your rights to collect, scrape, copy, upload, transmit, or use that data;
- your scraping, crawling, extraction, or monitoring activities, including any claim for trespass to chattels, breach of website terms, copyright infringement, database rights infringement, or unlawful access to third-party systems;
- your communications campaigns, consent practices, opt-out failures, telemarketing conduct, or carrier-policy violations;
- your use of AI outputs, targeting logic, or discriminatory decision-making; or
- your violation of these Terms or applicable law.
14. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms.
